O-1 Petition: Outline of the Case Preparation

You probably know that the O-1 case involves submitting a petition to USCIS. Submitting the petition is indeed a crucial step, but it’s not the first step. And it’s important to recognize that a lot of work must be done before submitting the petition. For this reason, we’ve assembled rough outline of the steps that lead up to submitting the O-1 petition.

What You Should Do Before Submitting the O-1 Petition

1. Determine whether the foreign worker qualifies for O-1 (or O-2) non-immigrant visa status.

2. Determine the type of petition to be used.

3. Collect employer or event documents and other required information.

4. Collect foreign worker documents and other required information from the foreign worker seeking O-1 status

5. Collect foreign worker documents and other required information from the foreign worker’s accompanying support personnel.

6. Collect documents from the O-1 and O-2 foreign workers’ dependent family members.

7. Prepare the O-1 petition and, if the O-1 foreign worker will be accompanied by essential support personnel, the O-2 petition.

8. File the O-1 petition and, if applicable, the O-2 petition together.
